Drunk Driving and Dram Shop Litigation
We are seeing more and more accidents at the hands of alcohol lately. Just yesterday I learned of another. What you may not know is that Alabama has strict laws regarding who served the alcohol, and they can be found liable for your injuries as well. It is known as the Dram Shop statute, and unfortunately a lot of attorneys don’t pursue this avenue of recovery – or worse, don’t even know about it. The law states that a bar is not allowed to serve alcohol to someone who is visibly intoxicated. If they do, then they can be held liable for the injuries the drunk driver causes.
Our last big dram shop case started as a car accident. One competing attorney knew there might be a claim against the local bar who over served, but didn’t know the name of the law. Another didn’t even mention the dram shop statute at all. We were able to recover another $100,000 for our client due to the dram shop statute!
